These Terms of Service ("Terms") govern your use of the Espresso State website and the purchase of products from our store. By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully before using our site.

Espresso State is an Australian-based online streetwear brand. Our store is operated via Shopify and products are fulfilled on demand through third-party print partners.

Eligibility

By using our website, you confirm that you are at least 18 years of age, or that you have the consent of a parent or guardian. You agree that the information you provide to us is accurate and complete.

Products

All products are printed on demand and made to order. As a result:

• Product colours may vary slightly from on-screen representations due to monitor settings and print processes

• Minor variations in print placement or sizing are not considered defects

• We reserve the right to discontinue or modify any product at any time without notice

Size guides are provided on our sizing page. It is your responsibility to review sizing information before placing an order. We are unable to accept returns for incorrect size selection.

Pricing and payment

All prices are listed in Australian dollars (AUD) and include GST where applicable. We reserve the right to update our pricing at any time. The price charged will be the price displayed at the time your order is placed.

Payment is processed securely through Shopify Payments. We accept major credit and debit cards. By submitting your payment details, you authorise us to charge the total order amount to your chosen payment method.

Orders

Once you place an order, you will receive a confirmation email. This confirmation is an acknowledgement of your order, not an acceptance. We reserve the right to cancel or refuse any order at our discretion, including in cases of pricing errors, suspected fraud, or stock unavailability.

If we cancel your order after payment has been processed, you will receive a full refund to your original payment method.

Shipping and delivery

Delivery timeframes are estimates only and are not guaranteed. Espresso State is not liable for delays caused by postal services, customs processing, or circumstances outside our control. Please refer to our Shipping Policy for full details on rates and estimated timeframes.

Returns and refunds

Our returns and refunds policy forms part of these Terms. Because all products are made to order, we do not accept returns for change of mind. Faulty, damaged, or incorrectly fulfilled items are eligible for a replacement or refund. Please refer to our Returns & Refunds Policy for full details.

Intellectual property

All content on the Espresso State website, including but not limited to logos, graphics, product designs, photography, and text, is the property of Espresso State and is protected by Australian and international copyright and trademark laws.

You may not reproduce, distribute, modify, or use any of our content for commercial purposes without our prior written consent.

User conduct

By using our website you agree not to:

• Use the site for any unlawful purpose

• Attempt to gain unauthorised access to any part of the site or its systems

• Submit false, misleading, or fraudulent information

• Engage in any conduct that could damage, disable, or impair the site

Limitation of liability

To the maximum extent permitted by Australian law, Espresso State is not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our website or products, including but not limited to loss of revenue, loss of data, or loss of opportunity.

Our total liability to you in connection with any order will not exceed the amount paid for that order.

Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law, including guarantees that cannot be excluded.

Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
